The Health & Safety (Offences) Act 2008
The act came into effect in January 2009 and has seen the level of fines increase significantly from £5k to £20k per offence. In addition, the act has seen the introduction of custodial sentences in circumstances, not necessarily resulting in a fatality, but which are nonetheless considered sufficiently serious. On both counts these are a significant departure from what has gone before.
